Imaam Barbahaaree speaks about the khawaarij (terrorists)

Imaam Barbahaaree (rahimahullaah) stated in Sharh- As Sunnah:

‘It is permissible to fight the Khawaarij if they attack the wealth of the Muslims, or the Muslims and their families, but if they are dispersed, then the Muslim Ruler is not to seek after them, nor are their wounded to be killed, nor is booty taken from them, nor may those taken captive be killed, nor are those who flee to be pursued.’

Shaikh Saaleh Al-Fawzaan (may Allaah preserve him) said:

And regarding the saying of Imaam Barbahaaree (rahimahullaah): ‘It is permissible to fight the Khawaarij if they attack the wealth of the Muslims, or the Muslims and their families;’ because the Prophet (sallal-laahu-alayhi-wasallam) commanded that they are to be fought, and because Ali (radiyallaahu-anhu) fought them when they attacked and killed Abdullaah Ibn Khabbaab al Arrat and ripped open the stomach of his pregnant wife.  So Ameerul Mumineen Ali (radiyallaahu-anhu) decided to fight them as they brought about a good reason to be fought against.

And regarding the saying of Imaam Barbahaaree (rahimahullaah): ‘But if they are dispersed, then the Muslim leader is not to seek after them’ If they desist from fighting, the ruler is not to chase them, nor carry out a military expedition against them, as long as they do not commit acts of transgression.  And no doubt they are misguided and are to be advised in hope that they may return (repentant) and are not fought.

And regarding the saying of Imaam Barbahaaree (rahimahullaah): ‘Nor are their wounded to be killed’; because the evil of the injured person is curtailed.

And regarding the saying of Imaam Barbahaaree (rahimahullaah): ‘Nor is booty to be taken from them’, meaning: their wealth is not to be taken as war booty; because it is the wealth of the Muslims.

And regarding the saying of Imaam Barbahaaree (rahimahullaah): ‘Nor may those taken captive be killed’ because they are Muslims, and by being injured and taken as captive their evil is curtailed.

And regarding the saying of Imaam Barbahaaree (rahimahullaah): ‘Nor are those who flee to be pursued’.  If they flee, the leader is to leave them alone and not go after them as their evil is curtailed.

Responsibilty of the Scholars and Rulers concerning the affair of the khawaarij—Shaikh Fawzaan (may Allaah preserve him)

The people of knowledge (i.e. the scholars) are of the view that it is obligated on the Muslims in every era that if they are certain about the presence of this filthy doctrine (i.e. the doctrine of the khawaarij), they should remedy it through calling to Allaah (i.e. the correct way) and enlighten the people about that. If they (i.e. khawaarij) do not obey (and come out fighting), then they are fought (by the Muslim ruler) in order to repel their harm.

“From that which is known to everyone who has the slightest bit of common sense is that hijacking airplanes and kidnapping children and the like are extremely great crimes, the world over. Their evil effects are far and wide, as is the great harm and inconvenience caused to the innocent; the total effect of which none can comprehend except Allaah.

Likewise, from that which is known is that these crimes are not specific to any particular country over and above another country, nor any specific group over and above another group, rather it encompasses the whole world.

There is no doubt about the effect of these crimes; so it is obligatory upon the governments and those responsible from amongst the scholars and other than them to afford these issues great concern, and to exert themselves as much as possible in ending this evil.”

Sheikh Saaleh al Fawzaan (may Allaah preserve him) said:

It is not permissible to exalt and praise the innovators, even if they have with them some of that which is the haqq.  That is because raising and praising them will spread their bidah and makes them from amongst the sincere ones, who are taken as examples from amongst the men of distinction of this Ummah.  The Salaf have warned us against having trust for the innovators, and have warned against praising them, and from their gatherings.  In this regard Asad Ibn Musa (rahimahullaah) wrote: ”And be beware of being a brother of the innovator (by association), or a companion of his, or one whom you sit with.  For indeed there has come the athar: ”whoever sits with a person of innovation; has left the protection of Allaah and is entrusted to himself.  Whoever proceeds towards a person of innovation has proceeded towards the destruction of Islaam”.

The innovators must be warned against and kept away from, even if they have some truth with them. Indeed, the most astray are not devoid of something of the truth, but as long as they have with them innovation, opposition and sinful views/ideas; then it is not permissible to praise and exalt them.  And it is impermissible not to have an objection towards their innovation, because in this is spreading of bidah and belittling the Sunnah.  And through this the innovator will emerge and become a guide for the ummah.

There are those Imaams in every era, who have no affairs of innovation with them.  And all Praise is due to Allaah, in them is that which suffices the ummah.  They are the leaders/guides.  What is obligatory is to make Ittibaa of the straight path which has no bidah.  As for the innovator, then it is obligatory to warn against him, and he is exposed until the people are cautious of him, and until him and his followers are subdued.  As for the consideration that he has something of the haqq; then this does not justify praising him.  This is, to a far greater extent against that which is of overriding benefit.  And it is known with regards to the fundamental principles of the religion that averting harm takes precedence over seeking that which is of benefit.  And with regards to showing animosity towards the innovator, the harm that is averted from the ummah is weightier than what he has of supposed maslahah, (if that is the case).
And had we adhered to this concept (i.e. praising innovators for some good they have), no one would have been judged to be misguided and declared an innovator.  This is because there is not an innovator except that he has with him some of that which is from the haqq and from iltizaam (adherence to Islaam).
