Is This Disobedience to my husband?

Question:

My husband requests that I stay up late at night with him but I refuse because I want to pray the night prayer, so I sleep early. Is this (refusal of mine) disobedience to a husband?

Answer:

It is incumbent upon you to obey your husband in good. If he calls you to stay up late and you will definitely fail to perform the fajr salaah at its fixed time or (he calls you to stay up late) to watch what is evil, then you do not obey him. As for other than this then it is obligatory to obey him even if the night prayer is missed because it is an (optional) Sunnah and obedience to a husband is obligatory.

“I broke the fast for six days due to examinations” – Shaykh Uthaymeen (rahimahullaah)

The Questioner Asks

I am a woman who was forced by circumstances to break my fast for six days in the month of Ramadhaan, and the reason for that was due to examinations because they began in the month of Ramadhaan and the subjects were difficult. And had I not broken my fast during those days I would not have been able to study those subjects bearing in mind that they were very difficult. I kindly request that you benefit me with what I must do so that Allaah may forgive me.

Shaykh Uthaymeen answers:

Firstly to give consideration for doing something based on circumstances is a mistake; but what is paramount is to say ”I was forced by severe necessity or what is similar to this (statement).”

Secondly her breaking the fast during Ramadhaan due to examinations is also a mistake and it is not permissible, because she is able to revise at night and there is no necessity to break the fast. So upon her is that she repents to Allaah (The Mighty and Majestic) and repeats those fasts, because she held an erroneous interpretation and did not abandon those days out of negligence.

Our Salaf: Yazeeb Ibn Thaabit

Abu khaythama narrated to us, (saying): Abdur-Rahmaan Ibn Mahdee narrated to us, (saying): Moosaa Ibn Ulayya narrated to us from his father who said: “Whenever a man asked Yazeed Ibn Thaabit about something, he said: “Is this for Allaah’s sake?” If he (the questioner) said: “yes”, he (Yazeed) would speak; and if not he would not speak.

[Part 2] Our Previous Teacher’s defence of a Mubtadi leads him to fantasy, lies and slanders

In The Name of Allaah, The Most Merciful, The Bestower of Mercy

The Messenger of Allah (may Allah’s peace be upon Him) said, “Whoever does not give up forged speech and evil actions, Allah is not in need of his leaving his food and drink”1

It is with great sorrow that we find ourselves having to respond to some outlandish claims, slanders and half-truths, made against Al-Markaz As-Salafi in this blessed month of Ramadhaan. The one who makes this claim—the leading E-mail sheikh, a previous teacher of ours who is now clinging to Hajoori Al-Haddaadi- seeks to incite splitting and rancour due to his evil suspicions. Allaah (The Most High) said:

“O you who believe! Avoid much suspicions, indeed some suspicions are sins” [Surah 49:12]

Imaam as-Saa’di (may Allah have mercy upon him) said: “Allaah (The Most High) has forbidden much evil (sinful) suspicion towards the believers, because some suspicions are sins. And that is like the suspicion devoid of reality and factual evidence, and like the suspicion accompanied by much forbidden speech and action. For indeed, the settlement of evil suspicion in the heart does not restrict the one (in whose heart is that evil suspicion) only to that; rather, he does not cease until he utters and does that which is not permissible/befitting.” [End of Quote]

It is as though he hasn’t heard the statement of the Messenger of Allah (may Allah’s peace and blessings be upon him) who said “Whoever does not give up forged speech and evil actions, Allah is not in need of his leaving his food and drink”2

Likewise, Anas Bin Malik reported: The Messenger of Allah (may Allah’s peace and blessings be upon him) said, “When I was taken upon my night journey, I passed by a people who had metal hooks in their hands and they were clawing at their faces and necks. I said: who are these, O Jibreel? He said “These are the ones who eat the flesh of people (49:12) and disgrace their honor.”3

Indeed it is a calamity outside the month of Ramadhaan (let alone within it!!) that this person takes so freely to his keyboard and computer carrying out such repugnant actions. His attempt to defame Al-Markaz As-Salafi is only due to his own whims and desires. He attempts to spread evil suspicion, false stories and half-truths and stitch together a weak spider’s web; creating a version of events that is in agreement only with his desires; and far removed from reality. This is the state of affairs of this particular Leading E-mail shaykh (Hajoori Fanatic) who has returned to trouble the people… Even in in this blessed month of Ramadhan… Spreading tales about Al-Markaz As-Salafi; seeking by way of it to taint the Dawah in Manchester and blame Al-Markaz As-Salafi and others for his own inability to submit to the truth. Indeed, his clinging onto Yahyah al Hajoori Al-Haddaadi Al-Mubtadi has blinded and removed all sense of justice in dealing with those who transmit the verdict of the scholars against him.

The first of those fabrications pertains to the masjid allegedly inviting a takfeeri to make Ruqya in the masjid and charge for it!

So let us be clear: No such thing ever happened! Yet, maybe through subliminal messages and self-suggestion, he has in fact managed to convince himself that it actually did happen!?!… And we seek refuge in Allah from such delusion! As Abdullah bin Mas’ud reported that Muhammad (may peace be upon him) said: “Should I inform you that slandering, that is in fact a tale-carrying which creates dissension amongst people, (and) he (further) said: The person tells the truth until he is recorded as truthful, and tells lies until he is recorded as a liar.”4

It is as though he has repeated the same lie enough times (to himself and others) and has ended up believing it! This slander began a while ago with “I recently came across an event which is going to take place in the vicinity of the Mosque;” but then spiralled and grew to finally becoming one of the masjid’s alleged “crimes against Salafiyah… bringing a Takfiri to do ruqyah in their centre…and charge £50.” This fictitious event (which is reality in his mind) is just one of those many things generated due to rage at his teacher being refuted by the scholars; verdicts that were posted on this and many of the websites of the Salafi Centres and Masaajid around the country.

So instead of accepting the knowledge based refutations of the scholars and the students against Hajoori, this leading email sheikh [Hajoori fanatic] clings onto a fictitious affairs which he believes are real crimes committed by Al-Markaz As-Salafi.

What makes this fanatism towards Hajoori even clearer, is the written statement of his “what is this to do with shaikh Yahya.” This absurd rhetorical question may seem a bid to protest the innocence of his shaykh, but in reality it is the employment of an evil method, to fault find, attempt to drag others down and accuse others of having grave errors with them; sowing the seeds of shubha (an evil doubt which is a half-truth used to intend falsehood thereby fooling the people) in the hearts of the people against their brothers and sisters. In this case he attempts to place the entire masjid in the same category as hizbees and people of bidah(!!?!) writing “ they have the same way as the hizbi of sunnah (i.e. hizbiyyoon of Masjid As-Sunnah- followers of Maribi, Halabi) and elsewhere.”

This manhaj of blanket tabdee’ is the same evil and destructive methodology employed by al-Hajoori! Shaykh Rabee’ put this method of theirs in one clear and concise statement, “My brother, we have schools… many thousands, all of them are upon the Salafi manhaj, they call to Salafiyyah and they defend it, (yet) they are all under the feet (according to al-Hajuri and followers). (Such schools are in) the Kingdom, in Yemen, in Algeria, in all of the countries, (but) everything is under the feet.”

So we advise this leading Hajoori Fanatic of Manchester to fear Allaah and restrain his tongue from falsehood. We sincerely urge him to be mindful of excessiveness, as the Messenger (May Allah’s Peace be upon him) said: “The over-stringent ones are destroyed.’’5  Imaam Nawawi (rahimahullaah) said: “The over-stringent ones are those who look too deeply (into affairs) and are excessive- those who exceed the Hudood (prescribed legislated sharia boundaries) in their statements and actions.’’6

We seek Allaah’s protection from exaggeration, bigotry, fanaticism, slander and recklessness.

The Mercy of Messenger (sallal-laahu-alayhi-wasallam)–Rather (open for them) the door of mercy and repentance

Narrated Ibn Abbaas (radiyallaahu anhumaa): The Quraish said to the Prophet (sallal-laahu-alayhi wasallam): ”Invoke your Lord to bring forth for us a mountain of gold and we shall believe in you.” He (sallal-laahu-alayhi-wasallam) said (to them): “Will you do so?” They said, “Yes”. He (sallal-laahu-alayhi wasallam) invoked (Allaah), so Jibreal came to him and said: “Indeed, your Lord conveys His peace and blessings upon you and He says: “If you wish there will be a mountain of gold for them and whoever amongst them disbelieves after that, then I will punish him with a punishment such as I have not inflicted on anyone among all (mankind and Jinn); and if you wish I will open for them the door of repentance and mercy.” He (sallal-laahu-alayhi-wasallam) said: ”Rather (open for them) the door of repentance and mercy.”

Pregnancy in Ramadhaan – Fasting or Paying Fidyah or Making Up the Fasts – Shaykh Al Albani

‘SILSILAH FATAAWAA JEDDAH’ CASSETTE SERIES (no.25) OF SHAIKH AL-ALBAANEE -rahimahullaah:

Questioner : “I read in a book that if the pregnant women or the breast-feeding women fear for themselves, or for their child, that they should abstain from fasting, and should feed a needy person in place of each day, and that it is not obligatory upon them to make up the days. So how correct is this saying? We hope that you can clarify.”

Shaikh al-Albaanee: “Making up the days is not obligatory upon them, but rather kaffaarah (compensation) of feeding a needy person for each day is obligatory. This is the correct answer.

As for the aforementioned condition, i.e. that if the pregnant woman or a breast-feeding woman fear for themselves or for their child, then this condition is just an ijtihaad (personal deduction) from some of the scholars, and it should not be put as a duty upon the pregnant woman or the breast-feeding woman, because the Prophet (ﺻﻠﻰ اﷲ ﻋﻠﻴﻪ و ﺳﻠﻢ) said:

Allaah -the Exalted and Most High- has remitted fasting from the pregnant woman and the breast-feeding woman.1

Then Ibn `Abbaas said in explanation of His Saying -He the Most High:

[Observing Saum (fasts)] for a fixed number of days, but if any of you is ill or on a journey, the same number (should be made up) from other days. And as for those who can fast with difficulty, (e.g. an old man), they have (a choice either to fast or) to feed a Miskîn (poor person) (for every day). But whoever does good of his own accord, it is better for him. And that you fast, is better for you if only you know.[] [Sooratul-Baqarah (2):184]

[[Meaning: So whoever amongst you is ill, or upon a journey, then let him fast the same number of other days; and as for those of you who can fast with difficulty, then they have the option of feeding a needy person in place of each day.]]

Ibn `Abbaas -radiyallaahu `anhu- said: “Upon the pregnant woman and the breast-feeding woman is to feed (the needy).”

Meaning the aforementioned condition is not to be found, i.e. that the pregnant woman and the breast-feeding woman have to fear for themselves or for their child.”

By the Tawfeeq of Allaah (The Most High), the sensible students of Al-Hajoori, the sensible Salafi students in the Uk and the Maraakiz of Salafiyyah have abandoned the vile Haddaadi Innovator Yahyah Al-Hajoori. But sadly, our previous teacher—a friend of Al-Hajoori Al-Haddaadi Al-Mubtadi– still defends him and expresses rage against us for transmitting the verdicts of the scholars. We have not criticised him except due to his defence of a vile Haddaadi Innovator. Indeed, it is very sad that this bigot has once again embarked upon the destructive path of exaggeration whilst propagating falsehood, half-truths and confounding truth with falsehood, especially in this blessed month of Ramadhaan—defending an innovator!

Would it be praiseworthy if we still love this previous teacher or listen to his opinions even though he persists in his fanatical and bigoted defence of Al-Hajoori the Haddaadi, the Innovator?! Why is it that this man–over forty years of age—cannot still comprehend and accept reality?! Yes he was beloved to us in the past because he was not a defender of any innovator, but at present he is abandoned and given no consideration due to his persistence upon bigotry, fanaticism and falsehood?!

Inshaa-Allaah, we will reply to all his foolish and ill-informed attempts, which he hopes will aid him in propagating half-truths and confounding truth with falsehood. May Allaah guide him and make him realise his foolish behaviour.
