Pregnancy in Ramadhaan – Fasting or Paying Fidyah or Making Up the Fasts – Shaykh Al Albani

‘SILSILAH FATAAWAA JEDDAH’ CASSETTE SERIES (no.25) OF SHAIKH AL-ALBAANEE -rahimahullaah:

Questioner : “I read in a book that if the pregnant women or the breast-feeding women fear for themselves, or for their child, that they should abstain from fasting, and should feed a needy person in place of each day, and that it is not obligatory upon them to make up the days. So how correct is this saying? We hope that you can clarify.”

Shaikh al-Albaanee: “Making up the days is not obligatory upon them, but rather kaffaarah (compensation) of feeding a needy person for each day is obligatory. This is the correct answer.

As for the aforementioned condition, i.e. that if the pregnant woman or a breast-feeding woman fear for themselves or for their child, then this condition is just an ijtihaad (personal deduction) from some of the scholars, and it should not be put as a duty upon the pregnant woman or the breast-feeding woman, because the Prophet (ﺻﻠﻰ اﷲ ﻋﻠﻴﻪ و ﺳﻠﻢ) said:

Allaah -the Exalted and Most High- has remitted fasting from the pregnant woman and the breast-feeding woman.1

Then Ibn `Abbaas said in explanation of His Saying -He the Most High:

[Observing Saum (fasts)] for a fixed number of days, but if any of you is ill or on a journey, the same number (should be made up) from other days. And as for those who can fast with difficulty, (e.g. an old man), they have (a choice either to fast or) to feed a Miskîn (poor person) (for every day). But whoever does good of his own accord, it is better for him. And that you fast, is better for you if only you know.[] [Sooratul-Baqarah (2):184]

[[Meaning: So whoever amongst you is ill, or upon a journey, then let him fast the same number of other days; and as for those of you who can fast with difficulty, then they have the option of feeding a needy person in place of each day.]]

Ibn `Abbaas -radiyallaahu `anhu- said: “Upon the pregnant woman and the breast-feeding woman is to feed (the needy).”

Meaning the aforementioned condition is not to be found, i.e. that the pregnant woman and the breast-feeding woman have to fear for themselves or for their child.”

By the Tawfeeq of Allaah (The Most High), the sensible students of Al-Hajoori, the sensible Salafi students in the Uk and the Maraakiz of Salafiyyah have abandoned the vile Haddaadi Innovator Yahyah Al-Hajoori. But sadly, our previous teacher—a friend of Al-Hajoori Al-Haddaadi Al-Mubtadi– still defends him and expresses rage against us for transmitting the verdicts of the scholars. We have not criticised him except due to his defence of a vile Haddaadi Innovator. Indeed, it is very sad that this bigot has once again embarked upon the destructive path of exaggeration whilst propagating falsehood, half-truths and confounding truth with falsehood, especially in this blessed month of Ramadhaan—defending an innovator!

Would it be praiseworthy if we still love this previous teacher or listen to his opinions even though he persists in his fanatical and bigoted defence of Al-Hajoori the Haddaadi, the Innovator?! Why is it that this man–over forty years of age—cannot still comprehend and accept reality?! Yes he was beloved to us in the past because he was not a defender of any innovator, but at present he is abandoned and given no consideration due to his persistence upon bigotry, fanaticism and falsehood?!

Inshaa-Allaah, we will reply to all his foolish and ill-informed attempts, which he hopes will aid him in propagating half-truths and confounding truth with falsehood. May Allaah guide him and make him realise his foolish behaviour. Shaikh Uthaymeen said: ”Why would they not be from the most ignorant of people……!

”And when it is said to them (hypocrites): “Believe as the people (followers of Muhammad Peace be upon him, Al-Ansar and Al-Muhajirun) have believed,” they say: “Shall we believe as the fools have believed?” Verily, they are the fools, but they know not.” [Soorah Al-Baqarah Ayah: 13]

Shaikh Muhammad Bin Saaleh Al-Uthaymeen (rahimahullaah) said:

From the benefits of the ayah is an indication to the ignorance of the hypocrites, because Allaah (The Mighty and Majestic) negated knowledge from them due to His saying:”But they know not.” The reality is that they are from the most ignorant of people. Why would they not be from the most ignorant of people!–for indeed their path is deception, manipulation and misguidance. These hypocrites are from the most ignorant of people because they do not know the reality about themselves and that they are foolish (people).

Our Salaf: What if they saw the fabricators and pretenders amongst the innovators of today?!

Abu khaythama narrated to us, (saying): Jareer related to us from Mansoor from Abu Ad-Duhaa from Masrooq, (who) said:”Once we were sitting with Abdullaah (Ibn Mas’ood) whilst he was reclining; then a man came to him and said: ”O Abu Abdir-Rahmaan! Verily there is a story teller at the doors of Kinda claiming that the portent of the Smoke will come along and snatch the breaths of the disbelievers (i.e. take their souls away) and the believers will get something like a cold from it.” So Abdullaah said while sitting up and he was angry, ”O people fear Allaah! Whoever amongst you has knowledge of something, then he should speak with what he knows; and whoever does not know, then he should say, ”Allaah knows best”; because it the best of knowledge for one of you to say, ”Allaah knows best” with regards to things he has no knowledge of. Indeed, Allaah (The Most High) said to His Prophet (alayhis-salaam): ”Say (O Muhammad): No wage do I ask of you for this (the Qur’aan), not am I one of the Mutakallifun (those who pretend and fabricate things which do not exist)” [Soorah Saad. Ruling on Reading the Qur’an in the Mind, not Physically with Lips – Sh.ibn Baz

The following question was posed to Shaikh Bin Baz: “Some people get a mus’haf and look into it [reading in the mind] without moving their lips; is it still applicable to term this scenario as “reading the Qur’an”? Or is it a must to pronounce/utter the words and for that to be heard in order to deserve the reward for reading the Qur’an? And is a person rewarded for just looking into a mus’haf [reading in mind]?

 

There is nothing preventing looking into the Qur’an without reading [physically] to ponder and contemplate and understand the meanings, but the one who does this is not considered “a reader” [to have actually ‘read’ the Qur’an] and he does not receive the virtue of actually reading unless he pronounces the words and physically reads the Qur’an, even if those around him cannot hear [i.e. it is not required to be loud, but physical pronunciation required though], due to the statement of the prophet “Read the Qur’an for indeed it will come as an Intercessor for its companions on the Day of Judgement” [Muslim]. The prophet  صلى الله عليه و سلم intended by the ‘companions of it’ i.e. those who act upon it, just as it is mentioned in other ahaadith.

Similarly the prophet صلى الله عليه و سلم said, “Whoever reads a letter of the Qur’an so for him is a reward, and every reward is 10-fold of its example” [at-Tirmidhy & ad-Daarimy with an authentic chain]. And a person is not considered a “reader” unless he utters [and pronounces that reading], just as the people of knowledge have stated that.

FLOOD DAMAGE TO TROID (AL-HAMDULILLAAH)

On Tuesday July 9th, 2013 the city of Toronto and more specifically the city’s West End endured a massive thunderstorm. The storm dropped 126mm of rain in as little as 2hrs by the decree of Allaah. This rainfall total is almost double the monthly average (75mm) and the largest one day (even though it fell in 2 hrs) rain total ever recorded in the city of Toronto, even more than the 1954 fatal hurricane (Hazel) that destoyed most of the Humber River. Due to the extreme flooding, water from the sewer system backed up into sewer drains and into the basement of the centre. Despite many of the books in our storage area being elevated, the water/sewage rose more than 6 inches in the entire basement and wudhoo/toilets area. Most of the books are not salvageable (sellable) to suppliers.

Damage is estimated to be approx. $15,000. The condition of the wudhoo area and other parts of the basement has not been assesed yet for water damage, although it is a tiled and concrete area. This is a trial from Allaah, the Most Wise, we thank Allaah for this challenge and we are hopeful in Him alone, that it will bring about more good. We say this, whilst most of the kuffar are cursing the weather and behaving ignorantly rather than being in awe of Allaah and realising he is All Powerful and that we are but at the mercy of Allaah Subhaha.

We thank Allaah, then all of our brothers and sisters for their outpowering of concern and kind comments. It is heart-warming to see the love of Ahlus-Sunnah for one another and a clear sign of the unity of the people of Sunnah.

Abu Khaythama narrated to us, (saying): Mu-aawiyyah Ibn Amr related to us, (saying): Zaa-idah related to us from Al-A’mash from Maalik Ibnul Haarith from Abdur-Rahmaan Ibn Yazeed who said: It was said to Alqama: ”Why not sit in the masjid so that (the people) gather around you, ask you (questions) and we sit with you. Indeed, they ask those below you (in knowledge0” He (Abdur-Rahmaan) said: so Alqamah said: ”Indeed, I hate that (they) march behind me, saying: ”This is Alqamah; This is Alqamah.”
