Rulings Regarding the Slaughtering – Sh.Ibn Baz and Sh.Ibn ul-Uthaymeen

There is often much discussion and questioning that arises upon the issue of slaughtering, particularly on behalf of those family members who have passed away. This article will mention in a brief and summarised form some of the affairs linked to that from the speech of Shaikh bin Baz and Shaikh ibn ul-Uthaymeen رحمهما الله insha’Allah.

Firstly, as Shaikh bin Baz mentioned, the actual act of slaughtering is a highly recommended Sunnah, and not an obligation in the opinion of many of the people of knowledge. It is an act an individual should do on behalf of himself and his household.

The individual intending it cannot take from his hair, nails or skin from the beginning of Dhul-Hijja until he slaughters [hadith of Umm Salama with almost identical wording in Saheeh Muslim].

If however the individual does not slaughter the animal himself and instead appoints someone on his behalf, perhaps some type of butcher or slaughter house, or abroad [although not recommended by some scholars to have it done abroad, since the purpose of the slaughtering is not merely feeding the poor, in that instance everyone is able to send money as charity abroad any time, rather the slaughtering is a symbolic act in Islam which has benefits to the one slaughtering himself too, since it is Sunnah for the one slaughtering to eat from it himself and give to his relatives and neighbours], then in that case it is still the one who pays for the slaughtering that cannot take from his nails, hair and skin – as for the butcher or slaughter house people then they are free to do as they please regarding their hair, nails and skin since they are not the one intending the slaughter and paying for it, they are simply carrying out the act on behalf of someone else [Shaikh bin Baz].

Clearly as the Sunnah states, the individual slaughters for himself and his household, one slaughtering encompasses them all. However the issue at hand is regarding those who have passed away from the household; are they able to receive the reward for the slaughtering and therefore be included in the intention?

Shaikh ibn ul-Uthaymeen mentions this  issue can be sectioned into 3 categories:

1 – Slaughtering on behalf of a deceased individual who had actually given councel [stated in their “will”] to have a slaughtering done for them from their wealth; in this instance it is done and implemented as the deceased wished and is actually obligatory to carry out.

2 – An individual slaughters for himself and his family who are alive and present within his household, and within that also intends members that have passed away for the reward; once again this is correct and permissible.

3 – An individual slaughters specifically and exclusively on behalf of a deceased individual without including his living family in the intention or having any will upon that from the deceased; this issue is the point of discussion between the people of knowledge.

Shaikh ibn ul-Uthaymeen states that it has not been evidenced from the Salaf-us-Salih that they ever slaughtered independantly and exclusively for a deceased individual in this manner, rather the correct way is to slaughter normally for yourself and your living and present household and within that have the intention for the deceased members to receive the reward too, the father or mother etc. Although the Shaikh does not say that doing it exclusively is haraam or innovation, but instead states it is better to stick to the Sunnah as it has been evidenced.

Some scholars have stated however that perhaps slaughtering on behalf of the deceased exclusively could be viewed as a form of charity, or at the very least be comparable to charity and therefore permissible, although Shaikh ibn ul-Uthaymeen states in that case it is a stronger act to simply give in charity rather than opting for an alternative action that is only “comparable” and not the same. In conclusion therefore, Shaikh Uthaymeen views that it should not be done exclusively for the deceased.

Most Virtuous – Last 10 of Ramadan or 1st 10 of Dhul Hijja?

Allah سبحانه و تعالى has favoured certain times and places over others, and the servants have been encouraged to increase in their worship and obedience to benefit from the additional virtues of such times. However a question has been posed from times of old; Which is more virtuous – the last 10 of Ramadan or the 1st 10 of Dhul-Hijja?

Ibn ul-Qayyim stated, “So if you were to ask which 20 are the best? [i.e. days with nights – the last 10 days and nights of Ramadan or the 1st 10 days and nights of Dhul Hijja], then the correct statement is to say that the last 10 nights of Ramadan are better than the 1st 10 nights of Dhul Hijja, however the 1st 10 days of Dhul Hijja are better than the last 10 days of Ramadan”.

Ibn Kathir stated,”Generally it has been said regarding these 10 days of Dhul Hijja that they are the best days of the year as the hadith stated, and many [scholars] preferred them over the last 10 of Ramadan. That is because the same affairs are legislated in these days of Dhul Hijja as the last 10 of Ramadan in terms of prayer and fasting and charity etc [so they are similar in that sense] however there is a distinguishing factor for the days of Dhul Hijja and that is the performance of Hajj in them.

Although it has [also] been said [in another opinion] that the last 10 of Ramadan are better because within them is the Night of Decree [laylat ul-Qadr].

However some [scholars] took a middle course in this and stated that the first 10 days of Dhul Hijja are better than the last 10 days of Ramadan, and that the last 10 nights of Ramadan are better than the nights of Dhul Hijja – and in this manner the evidences are combined”.

Simplified Q & A on Hajj – Shaikh Bin Baz

The following are a selection of commonly asked questions regarding Hajj, all answers from Shaikh Bin Baz رحمه الله تعالى.

1- If an individual has a wet dream whilst in a state of Ihram then what is the ruling?

If he has a wet dream and semen exits then upon him is to have the ghusl and nothing more than that. Him being in state of ihram is still correct and is not harmed since a wet dream is not from his choosing to occur, and similar to that is a fasting person in the ruling.

2- Is it permissible to use soap that has a fragrance to it whilst in a state of Ihram, and also toothpaste?

There is no problem in that, since it is not considered as actual fragrance in its nature.

3- Is it permissible to wear some items of clothing on top of the Ihraam due to extreme cold or rain?

There is no problem in that, if an individual wore a cloth or something resembling that to protect himself from extreme cold or rain it is ok, however he must not cover his head.

4- If hair falls out accidentally does it harm my state of Ihraam?

If the hair falls out from a woman or man during wiping it in wudu or washing it then there is no issue, similarly if something from the beard of a man fell out whilst washing or making wudu then it does not harm the state of ihraam since it is not done with intent.

5- Is it permissible to place fragrance upon the Ihraam sheets before going into a state of Ihraam [i.e. so that the fragrance lasts after he becomes muhrim]?

It is not permissible to place fragrance upon the ihraam sheets even before going into a state of ihram, rather the Sunnah is to place fragrance upon his body, like his head or beard or underarms before assuming a state of ihram.

6- What is the ruling on fasting 9th Dhul Hijja?

It is Sunnah for everyone except for the one actually in Hajj, for indeed the Sunnah for the one actually in Hajj is to not be fasting on the day of ‘Arafah.

7- I incorrectly thought going from Safa to Marwa then back to Safa was one length, and therefore ended up doing 14 lengths [since Safa to Marwa is actually one] so what is the ruling?

Seven is the obligation, as for the other 7 it is from your own doing and not permissible, but you are excused due to your ignorance, however you should seek repentance and forgiveness and not do that again if you make Hajj or ‘Umra again.

 

Performing Hajj on Behalf of Someone – Shaikh Rabee’

The time for Hajj is upon the Horizon, with that regard, Shaikh Rabee’ bin Hady حفظه الله was asked about performing Hajj on behalf of someone and so he replied [paraphrased]:

“There is some difference [on some issues related to this affair]; there is one aspect the scholars agree upon and another aspect they differ on. They agree regarding the performance of Hajj on behalf of a relative, and that is due to the questions in the ahaadith related to the issue all being related to family members, some of them stating “my father died and did not make Hajj…”, others, “my mother died and did not make Hajj…”, and “my father is required to make the obligatory Hajj however he is old and weak…”. Similarly the hadith of Ibn ‘Abbas that the prophet صلى الله عليه و سلم  heard a man say “Labbayk for Shubruma”, so he صلى الله عليه و سلم asked, “Who is Shubruna?”, the man said, “A brother or relative of mine”. The prophet صلى الله عليه و سلم then asked, “Have you performed Hajj for yourself [before]?”, he said, “No”, so the prophet صلى الله عليه و سلم said, “Perform Hajj for yourself first then on behalf of Shubruma”.

Therefore some scholars restrict the affair to relatives only, i.e. only allowing for people to perform Hajj on behalf of relatives and they do not allow for people to pay someone the fees to perform it on their behalf if he is not a relative, [perhaps a random individual not even known to the actual person himself].”

[The other opinion of many of the scholars is clearly that it is permissible whether it is on behalf of a relative or otherwise, and that appears to be the opinion followed by many of the scholars]

The Shaikh then went onto say, “Hiring people to perform Hajj on your behalf has become a business for some, certain individuals may take money from several different  individuals and then perform one Hajj on behalf of all their names in one go! And I don’t know if they even [bother] to do it for any of them!” [Scolars have mentioned the impermissibility of this, like Shaikh bin Baz]

The Shaikh also mentioned, “Shaikh ul-Islam has a good opinion on this, if the one who takes money to go and perform Hajj on behalf of someone else genuinely has a desire to be with the muslims engaging in the rites of Hajj and obedience then it is good, and he will benefit himself and the one he performs the Hajj on behalf of. However if the intent is purely for the money and he does not care about the opportunity to go to make Hajj, then this is eating people’s wealth unlawfully”

In Defense of the Prophet Muhammad–by Shaikh Rabee Ibn Haadee Al-Madkhalee

In the Name of Allah, the Most Merciful, the Bestower of Mercy

All praises are due to Allah, and may Allah exalt the status of the Messenger of Allah and that of his family and his companions, and may He grant them peace.

As for what follows:

Some newspapers and other forms of media have spread hurtful, vicious information that could only emanate from the jealous, arrogant enemies of Islam and its Prophet (may Allah raise his rank and grant him peace).

That conduct comprises a calumniation of Muhammad, the Messenger of Allah and a distortion of his message by jealous individuals and Christian organizations, as well as envious and irresponsible columnists, like those who write for the Danish newspaper Jyllands-Posten.

Its writers mocked the best of Mankind and the most distinguished of the Messengers, Muhammad (may Allah raise his rank and grant him peace), the likes of whose nobility, honour, justice, and manners the earth has never known of. Neither has it known of a more complete and comprehensive message than his, nor a more just and merciful one.

It is a message that embraces belief in all of the prophets and messengers, honoring them and defending them from calumniation and defamation. It has also preserved an accurate history of the prophets, including Jesus and Moses. So whoever disbelieves in Muhammad and speaks of him in a derogatory manner has disbelieved in all of the prophets and disparaged of all of them.

Recently, some uncivilized miscreants made fun of the Prophet, drawing various pictures of him. Twelve despicable pictures, one of them portrayed him (may Allah raise his rank and grant him peace) wearing a turban resembling a bomb on his head.

We say to these criminals and their envious supporters in Europe and America: You are accusing others of your very own crimes! (*)

Let it be known that never did Muhammad (may Allah raise his rank and grant him peace), nor his righteous successors or any of his honorable companions, ever establish factories for even the most primitive of weapons, like swords and spears, let alone atomic bombs, long-range missiles, or any other weapon of mass destruction.

Never did Muhammad (may Allah raise his rank and grant him peace) build a single weapon factory. Rather, he was sent as a mercy for the entire creation, to guide all Mankind towards happiness in their worldly lives and in their hereafter, such that they fulfill their Creator’s right upon them, for it is He who created them to worship Him alone. Whoever rejects this is truly a criminal deserving punishment in this life and the next, by the Lord of all that exists, the Creator of this universe and its Master.

As for you O Westerners, claimants of civilization, you have constitutions and statutes that destroy upright moral character and permit all kinds of forbidden acts, the likes of fornication and sodomy, as well as usury which destroys the economies of entire nations, and the eating of improperly slaughtered animals (dead meats) and pork, something that causes the loss of concern for women’s values, and thus a man does not feel protective of his wife, sister, or daughter, and thus she fornicates with or intimately befriends whomever she pleases. These are some of the means which lead to ruin, and they have been prohibited in all of the prophetic messages.

As for bombs and all other weapons of destruction, war planes, tanks, and long-range missiles, you are the ones who engineered and manufactured them with your satanic minds that only think about transgression, animosity, oppression, attacking, tyranny, conquering entire races of people and enslaving them, spilling their blood, and usurping their natural resources. You think only about annihilating those who oppose you and stand in the way of your greedy aspirations, your oppression and spreading of hatred. All this wrapped up in the name of civilization, human rights, freedom, and justice!

All intelligent people know this about you. For your dark history is overflowing with uncivil and terrorist acts, a history recorded against you by both your enemies and allies alike.

Anyone who does not know this should read about your history and your occupation of numerous nations, or at least read the history and some horrible results of your two World Wars. For example, the number of fatalities in the First World War in Europe reached “More than 10 million, and they were the elite of their nations’ youth. And more than twice this number had incurred serious injuries disabling them for the rest of their lives.” [Refer to: At-Taareekh al-Mu’aasir: Uruubbaa minath-Thawratil-Fransiyyah ilal-Harbil-‘Aalamiyyaith-Thaaniyah, p.505. (Lit: Recent History, Europe from the French Revolution to the Second World War)]

The number of soldiers killed in the Second World War reached: “17 million, along with another 18 million civilian fatalities – all of them killed within a period of only five and a half years. Experts have estimated that the military expenses alone reached $1,100 billion, and that losses caused by the war reached the value of $2,100 billion. Added to this are the number of entire cities destroyed, the amount of earth scorched, the agriculture that was flooded, and the factories and plantations that stopped production, not to mention the number of livestock that were destroyed or lost.” [(Al-Harb al-‘Aalamiyyah ath-Thaaniyah by Ramadhaan Land, p.448-449) (Lit: The Second World War)]

The Hiroshima Bomb

Stated the author of the book, “al-Harb al-‘Aalamiyyah ath-Thaaniyah” (p.446-447) (Lit: The Second World War), “And perhaps it is appropriate to speak about this first atomic bomb. Let us relay what was reported directly from one of the Japanese in his interview with Marcel Junod, a representative of the Red Cross, speaking about the reality of this most frightening explosion. He said: …And suddenly there appeared these intense, muddy pinkish lights, accompanied by an unnatural tremor. This was immediately followed by an asphyxiating wave of heat and violent winds that ravaged everything in their path.

Within only a few seconds, thousands of people who walked the roads or sat in the city’s main streets were burned alive. A great number were then killed by the intense heat that spread all over. Others were left lying on the ground screaming in pain with deadly burns all over their bodies. Anything that had been at the point of impact – walls, homes, factories, and other buildings – was completely and totally annihilated, with all traces of these things sent hurling into the sky in a ghastly whirlwind. Trams were plucked from their steel tracks and flung as if they had lost their weight and substance. Trains were lifted off the ground along with their tracks as if they were mere toys. Horses, dogs, and livestock were all befallen with what befell the people. Every living thing had lost its life in one painful turn of events too difficult to describe. Trees were engulfed in blazing fires, rice fields lost their color, and farms crackled and burned away like dry straw.

As for the surrounding areas that escaped instant death: Homes were crumbled and only piles of wooden boards remained amongst bricks and stone foundations. Everything was crushed as if they were cardboard houses in a zone of destruction 10 kilometers in diameter. Those who survived found themselves totally surrounded by raging fires. The few people who managed to get to any type of shelter in time died painful deaths from gamma radiation within 20 to 30 days. By nightfall on the day of the blast, the blaze slowed down and then died out, finding nothing left to fuel it. Hiroshima had passed away into nothingness.”

These are some of the landmarks of your civilization that you sing and boast about, and become insolent towards Islam and its Prophet with. Yet you continue intensifying every form of oppression and corruption and you go on inventing more and more weapons of destruction, annihilation, and devastation, and this – by Allah – is the utmost limit of barbaric and animalistic behavior.

They are only like cattle, rather, even more astray than that. )

So crown yourselves with your own bombs, including the Hiroshima bomb and its likes, and crown your leaders with them. Consider all other weapons of mass destruction as your fangs and claws that you use to prey upon wild animals and all of Mankind.

The Committee of Major Scholars On Imaam Albaanee

The man is known to us to (possess) knowledge and virtue, exalting the Sunnah and giving service to it, and aiding the Madhab of Ahlus Sunnah Wal Jamaa-ah in warning against bigoted partisanship and blind following, and his books are beneficial. However, he is just like others amongst the scholars, he is not infallible; he is correct (at times) and mistaken (at times) and we hope for him two rewards in what he is correct and one reward in what he is mistaken, as established from the Prophet (sallal-laahu-alayhi-wasallam) that he said:

“When a haakim (i.e. a judge or scholar who has reached the station in knowledge making him qualified to perform Ijtihaad) strives to make a ruling and is correct, he receives two rewards, and if he makes a wrong ruling he receives one reward.’

Shaykh Fawzaan: Is this Supplication sufficient?

 

Shaykh Fawzaan was asked:

 Is this supplication considered comprehensive and sufficient over the other supplications:

‘O Allah indeed I ask you for the good which your prophet Muhammad sallallaahu alaihi wa sallam and your righteous slaves asked you for’

Answer:

This is a tremendous supplication, however it does not remove the need for the remaining supplications; rather the people supplicate with all the supplications they are aware of, increasing (in) good and he doesn’t restrict himself upon any one (supplication).

The prophet sallallaahu alaihi wa sallam did not restrict himself upon one (supplication) rather he used to supplicate with this one sometimes, this one sometimes and this one sometimes (i.e he would vary the supplications he would make).

What is ruling on delaying following the Imaam to increase in Dua? Shaykh Fawzaan

Question:

What is the ruling on delaying (following) the Imaam whether it was during Rukoo (bowing) or whilst in the state of prostration or other than that for the purpose of supplicating , and what is the proof?

Answer:

The Messenger (sallallaahu alaihi wa sallam) said: “The Imaam is to be followed”1 so there is no delaying (of following) the Imaam and there is no preceding him. The Imaam is followed and this is that which the Prophet (sallallaahu alaihi wa sallam) commanded. ” Bow when he bows, prostrate when he prostrates, and when he says ‘Sami Allahu liman-hamidah (Allah heard those who sent praises to Him) say then ‘Rabbana wa lakal-hamd’ (O our Lord! All the praises are for you)”2

So the Imaam is to be followed; this is that which the Messenger  (sallallaahu alaihi wa sallam) commanded with.
